Korea’s Annual Leave Rules: What Every Employer Must Know
Annual leave is a legally guaranteed off day for employees. Similar to other countries, Korea also has an annual leave system. Some parts may be similar to what you have in your home country, while others may be different.
Let’s take a look at the basic concept of annual leave in Korea.
①15days of annual leave
Employees who have worked at least 80% of the working days in a year are entitled to 15 days of annual leave.
These 15 days are the basic annual leave, and the number of annual leave days can increase depending on the employee’s length of service, up to a maximum of 25 days.
②Company with an average of 5 employee
Annual leave is only mandatory for companies with an average of 5 or more employees.
So if your company has only 1–4 employees, annual leave is not legally guaranteed. Nevertheless, the company can still provide annual leave by specifying it in the employment contract.
③Salary for unused annual leave
When an employee does not use their annual leave, the company should pay it out as salary, which can be a burden for the company.
To avoid this, the company can give written notice instructing the employee to use their annual leave. the employee still does not use the leave despite this notice, the company is not obligated to pay salary for the unused days
